Please read these terms and conditions before registering with All Vacation Exchange.

By registering with this site, or any service on this site, you signify YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS OF SERVICE.

1 - Presentation

All Vacation Exchange is a product of EasyTours S.A.R.L. and an introduction website for its members. The purpose of this website is to offer a structure for its members to contact other members of All Vacation Exchange in order to arrange a house-sitting transaction, a boat exchange transaction or a youth linguistic exchange transaction all around the world and throughout the year. The information of each property and each member will exclusively be shared with other members of All Vacation Exchange. The information contained herein is private and will not be shared in the public domain. Accordingly, neither All Vacation Exchange nor its representatives offer any guarantee and make no warranty that the member will find a transaction (house-sitting, boat exchange, youth linguistic exchange) with a compatible partner, and that a transaction will result.

2 - Generalities

All Vacation Exchange saves the right to amend, remove, or add to these terms and conditions at any time without notice. Such modifications shall be effective immediately. Accordingly, please continue to review these terms and conditions of service whenever accessing or using this site. If you do not agree with all of the terms of this Agreement, you may not access or use any part of this service.

3 - Use of All Vacation Exchange website

a. All Vacation Exchange services are available only to persons who can form legally binding contracts under applicable law. Registration is not available under the age of 18 years old in France, or age of majority in your jurisdiction of residence.

b. Do not attempt to place any kind of commercial ad on this site; any member using this site for other purposes than organising a house-sitting transaction, boat exchange transaction or youth linguistic exchange program will be removed immediately. Trading of any kind of products (i.e. firearms, tobacco, and alcohol) is not permitted, as well as listings containing links to adult sites or affiliate ads.

c. Members may describe their listing accurately and may not provide false or misleading information to All Vacation Exchange and its members. At any time, you can change your information online.

d. For any youth exchange program under the age of majority, parent or legal representative must register.

e. Copyright: The website contains copyright material, trademarks and other proprietary information including but not limited to text, photos, videos, software and the entire contents of this website are copyrighted under the French copyright laws. Subscriber may not modify, publish, transmit, participate in the transfer or sale, or in any way exploit any of the content in whole or in part.

f. Members shall not upload / post or otherwise make available any material protected by copyright, trademark or other proprietary right without the permission of the owner.

g. Any photos members submit to All Vacation Exchange may be used for promotional or other purposes by All Vacation Exchange.

h. In order to reach and to use the All Vacation Exchange site like communicating with your correspondents, it falls to you the responsibility to acquire and maintain in state and with your expenses the necessary equipment.

i. Members may terminate or close their membership at any time by contacting All Vacation Exchange when the exchange is finished. Refunds will not be given when members terminate or close their membership even if it remains time of membership.

j. The membership is a non-refundable service. The fee you agree to pay to All Vacation Exchange is a non-refundable fee.

k. All Vacation Exchange saves the right to remove, at its discretion, any member who would not respect the terms of use, deleting his account, his advert(s) with no refund.

4 - All Vacation Exchange Member Trust Agreement

a. As a member, you certify that the information you put in your listing(s)/advert(s) is true, with a fully and accurately property description, family description and any other description and illustration.

b. You must be courteous, fair and honest in all your dealings with other members and you are required to answer to all reasonable requests.

c. You are responsible for ensuring that your listing(s)/advert(s) information is kept current and up to date.

d. You guarantee the negotiated transaction dates and will warn your correspondents of any changes of dates, or any last minute changes.

e. You must ensure that the property used for house-sitting or youth linguistic exchange transaction, the boat used for exchange works properly and is clean upon your arrival and upon your departure. You must declare any damage that could happen during your stay.

f. You must be respectful of each others\’ property at any time as if they were yours.

g. If you cause any damage during your stay, you should notify immediately your partners.

5 - Privacy Policy

All Vacation Exchange wants to assure you that protecting consumer privacy is fundamental.
Personal contact information of each member is always hidden and is never displayed in a listing / an advert. Neither members nor visitors of All Vacation Exchange have access to your private contact information. Your name and contact information you provide to All Vacation Exchange website are not sold or given to anyone.
When registering to become a member of All Vacation Exchange, we use your information to create your member account. Once you finish your registration, you will receive a message from us to the e-mail address you provide in your contact information in order to confirm your membership.
All Vacation Exchange has developed a secured e-mail system for allowing free contact between members without divulging any personal information. Our system hides your personal contact information yet makes it possible for a member to contact you directly from your listing/advert. When a member sends you an e-mail through our website, it does not reveal your name, or any of your contact information.
As a member, you may not disclose or share your password to any third parties or use password for any unauthorized purpose. You are responsible for anonym zing your e-mail and your password and/or other personal contact information.
In accordance with the French law n° 78-17 “Informatique et Libertés” in force since the 6th of January 1978, members enjoy a right of access, correction, modification and deletion of the data related to them. Information on names, particulars, addresses and e-mail addresses, communicated by members when they subscribe, are strictly confidential. E-mail addresses are accessed solely by registered members and those that wish to remove theirs can do so at their convenience. Data supplied by members are not communicated to other organisations or agencies and e-mail addresses are protected against spamming, as long as it does not come from a member, in which case it should be brought to the attention of All Vacation Exchange so that the trouble could be ceased.
All Vacation Exchange reserves the right to change its Privacy Policy from time to time by posting such changes on the site. Changes will be effected immediately upon notification on the site. Your continued use of the site following notification will constitute your acceptance of those changes.
All Vacation Exchange may contain links to other sites not affiliated with All Vacation Exchange. Please note that these other sites may have privacy policies that differ from those of All Vacation Exchange. We have no control over any personal information that you provide to these sites.

6 - Responsibilities

a. All Vacation Exchange is only responsible for publishing listings/adverts and relies on the integrity and responsibility of the listing/advert. All Vacation Exchange does not verify the existence or content of any property and does not guarantee a transaction of any kind. All Vacation Exchange is not responsible for the actions of members, and claims no responsibility for the accuracy, content, or availability of information accessed or linked to through use of this service. All the users of All Vacation Exchange take sole responsibility for all agreements reached through use of this site.

b. It is not possible for All Vacation Exchange or its representatives to inspect the property of the members registered. Accordingly, neither All Vacation Exchange nor its representatives accept any responsibility or liability for the quality, fitness for purpose or state of the member\’s property, nor can All Vacation Exchange or its representatives accept any liability for any damage, accident or injury which might occur to the member or any member of his family, or any person accompanying the member to the member partner\’s property, or to whom the member allows access whether as visitor tradesman or otherwise.

c. The Use of the All Vacation Exchange website and any information obtained from that site is at your sole risk. If All Vacation Exchange is unable to provide the promised level of service for any reason, including, but not limited to negligence, service outrages, acts of God, neither All Vacation Exchange, nor its employees or any individual associated with All Vacation Exchange can be held liable for any costs beyond the actual cost paid by the client for the services. Neither All Vacation Exchange nor any of its affiliates will be liable for any compensatory, direct, indirect, special, incidental or consequential damages, loss of data, income or profit, loss of or damage to property, or any claims of third parties arising from use of the website, regardless of the legal theory on which the claim is based, whether in an action of contract, negligence or other tortuous action, arising out of or in connection with the use or performance of this information. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages. In no event shall All Vacation Exchange be liable for any amount in excess of the membership fees paid by the member.

d. Indemnification: You agree to indemnify and hold harmless All Vacation Exchange, or its representatives, from any injury or damage suffered directly or indirectly as a result of your use of the All Vacation Exchange listing services, including but not limited to any claims for injury or damage to person or property arising from a property you own; any claims for injury or damage to person or property arising from a property transaction to which you are a party; a violation of the Terms and Conditions of Use by you or anyone using your computer (or account, where applicable); a claim that any use of the Service by you or someone using your computer (or account, where applicable) infringes any property right of any third party; any misrepresentation by you; or any breach of any agreement to be performed by you. You agree to pay any and all costs, damages and expenses, including, but not limited to, reasonable legal fees and costs awarded against or otherwise incurred by or in connection with or arising from any such claim, suit and action or proceeding attributable to any such claim.

All Vacation Exchange reserves the right to remove any members\’ listing(s)/advert(s) at any time, and/or terminate the member\’s access to the website and/or to revoke any membership, at its sole discretion, for violation of these terms and conditions of use.
